Terms of Use and Privacy Policy

Disability Visibility Project® is a registered service mark of Disability Visibility LLC (“DVP” or “we”). DVP provides the content on this website (www.disabilityvisibilityproject.com) (the “Site”) to share the diverse voices of people in the disability community and preserve their history for all.  By using the Site, you accept and agree to abide by the terms below.

Permitted Use of Content

All information, documents, text, images, audio, video, trademarks, logos, graphics and other content (the “Content”) are made available to you on the Site by DVP. The Content may be owned by DVP or provided by third parties under license to DVP. The Content licensed from third parties is, in each case, the copyrighted work of the licensor.

Except as otherwise indicated, DVP authorizes the Content to be used and shared subject to the Creative Commons Attribution-NonCommercial International 4.0 license (CC BY-NC 4.0 License).  Under this License, you are free to reproduce and share the Content in any medium or format, and to transform or build upon the Content, for non-commercial purposes only and subject to any other restrictions of the License.  

For all such uses of the Content, you must include appropriate credit to DVP and/or relevant third parties where applicable, provide a link to the License, and indicate if changes were made, as more fully described in Section 3.a of the License.

Prohibited Use of Content

This Site may be linked to other sites that are not under the control of or maintained by DVP. You acknowledge that DVP is providing these links to you only as a convenience, and further agree that DVP is not responsible for the content or links displayed on such sites.

User Submissions

You acknowledge that you are responsible for the information and material that you submit (each a “Submission”) through public and/or private comment areas, emails, or other services available in connection with this Site, and that you, and not DVP, will have full responsibility for each such Submission, including its legality, reliability, appropriateness, originality and copyright.

You agree that DVP will be free to use or disseminate a Submission on an unrestricted basis for any educational, promotional, or non-commercial purpose. In the event that DVP publishes your Submission, you hereby authorize DVP to make the Submission available for use and sharing by the public under the terms of the CC BY-NC 4.0 License, a summary and full text of which can be found here: https://creativecommons.org/licenses/by-nc/4.0/

You further agree that you will not upload, post or otherwise make available on the Site any material protected by copyright, trademark, or any other proprietary right without the express permission of the owner of such copyright, trademark or other proprietary right, and the burden of determining that any material is not protected by any such right is on you. You shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights, or any other harm resulting from your Submission.

DVP asks that you respect our on-line community and participating individuals. Your conduct should be guided by common sense and basic etiquette. To further these common goals when posting Submissions to or otherwise using the Site, you agree not to post any content that is off topic, contains personal attacks or expletives, or is otherwise ableist, abusive, threatening, unlawful, harassing, discriminatory, libelous, obscene, false, pornographic, or that infringes on the rights of any third party.

DVP reserves the right to monitor Submissions by Site users in its sole discretion, to edit, or remove any Submission that, in DVP’s judgment, does not comply with the foregoing terms.

Privacy

We do not share personal information with third parties nor do we store information we collect about your visit to this Site for use other than to analyze content performance through the use of cookies, which you can turn off at any time by modifying your Internet browser’s settings.

Disclaimer of Warranties and Limitation of Liability

As more fully described in the CC BY-NC 4.0 License, DVP offers the Content as-is and as-available, and makes no representations or warranties of any kind concerning the Content, whether express, implied, statutory, or other, including without limitation, warranties of title, merchantability, fitness for a particular purpose, non-infringement, accuracy, or the presence or absence of errors.  In no event will DVP by liable to you on any legal theory for any direct, special, indirect, incidental, consequential, punitive, exemplary, or other losses, costs, expenses, or damages (collectively, “Losses”) arising out of the License or use of the Content, even if DVP has been advised of the possibility of such Losses. 

Modifications

DVP can revise this Terms of Use and Privacy Policy at any time by updating this posting. You agree that your continued use of the Site after such modifications have been made constitutes your acceptance of such revised terms.

Applicable Law

This Terms of Use and Privacy Policy and any amendments or revisions shall be governed by applicable federal law and the laws of the State of California, without regard to its conflict of laws principles.
